Statutory Leave Framework in India
In India, employee leave entitlements are regulated by state-specific Shops and Commercial Establishments Acts, the Factories Act, 1948, and the Maternity Benefit (Amendment) Act, 2017.
Standard Leave Categories in Indian Organizations
- Earned Leave (EL) / Privilege Leave (PL): Typically earned at the rate of 1 day for every 20 working days. Unavailed EL can usually be carried forward (up to 30 or 45 days) or encashed upon separation.
- Casual Leave (CL): Provided for unforeseen personal obligations, usually 7 to 12 days annually, which expire at the close of the calendar year.
- Sick Leave (SL): Granted for medical recovery, typically 7 to 10 days per year, often requiring a medical certificate if extending beyond 2 consecutive days.
- Maternity Leave: Mandatory 26 weeks (182 days) of fully paid leave for women with up to two surviving children under the Maternity Benefit Amendment Act.
